Terms of Service
Last updated 9 October 2026
These terms are an agreement between the business that signs up for Fresh POS (“you”) and TheFreshTech, LLC (“we”), the company that provides it. By creating an account or using the service you accept them. If you accept on behalf of a business, you confirm you are allowed to.
The service
Fresh POS is a point of sale for cafés and restaurants: ordering, kitchen display, payments, cash, stock, staff, customer and WhatsApp tools, on the web and in the mobile app. We may improve, change or retire features, and will tell you in advance about a change that removes something you rely on.
Your account
- Give us correct details and keep them up to date.
- You are responsible for what happens under your account, including what your team does. Give each person their own sign-in and the lowest role they need.
- Keep passwords and PINs private and tell us quickly about any misuse.
Plans, prices and payment
Plans and prices are shown in the pricing section and are per location. Yearly billing is shown with its discount. Taxes may be added. We will tell you before a price change takes effect, and it will not apply to a period you have already paid for. Unless we agree something different in writing, you can cancel at any time and the plan then ends at the close of the period you paid for.
Your data
Your menu, orders, customers, staff and other data stay yours. You allow us to store and process them only to provide the service, as described in our Privacy Policy. You are responsible for having a lawful reason to hold your guests’ information, for honoring a guest’s opt-out, and for only messaging people who agreed to be messaged.
Card payments and WhatsApp
- Card payments use your own Stripe account, so the money is yours. Stripe’s terms apply, and we take our fee as Stripe’s application fee. A payment counts as paid only when Stripe confirms it.
- WhatsApp ordering runs on your own WhatsApp Business number. Meta’s terms and policies apply, and you are responsible for the messages you choose to send.
Acceptable use
Do not use Fresh POS to break the law, to send spam, to harm or probe the service or other users, to reach data that is not yours, or to resell the service without our permission.
Availability
We work to keep Fresh POS running but cannot promise it will always be available or error-free. Plan for the occasional outage: keep a way to take orders and payments, and check your reports and tax figures before relying on them.
Ending the agreement
You can stop using Fresh POS and close your account at any time. We may suspend or end an account that breaks these terms or puts the service or others at risk, and will explain why where we can. After closing, you can ask for a copy of your data and then we delete it as described in the Privacy Policy.
Liability
To the extent the law allows, the service is provided “as is”, and we are not liable for indirect or lost-profit losses, or for more than the fees you paid us in the 12 months before the claim. Nothing here limits a right you have by law that cannot be limited.
Changes and law
We may update these terms and will change the date above; for an account holder we will tell them about changes that matter. Continuing to use the service afterwards means you accept the new terms. The laws of the place where TheFreshTech, LLC is established apply, unless your local consumer law says otherwise.
